Daniels legacy on line with Ind.'s $205M tax error

(AP) ? Gov. Mitch Daniels has built a national image as a persnickety fiscal manager with an eye for detail, but two massive accounting errors that have tilted Indiana's books by more than half-a-billion dollars threaten to tarnish that reputation as the popular Republican prepares to leave office.

State officials announced Thursday that a programming error at the Indiana Department of Revenue led the state to mistakenly withhold $205 million that should have gone to county governments. It was similar to a programming mistake disclosed in December, when budget analysts discovered $320 million the state didn't know it had.

Revenue department commissioner John Eckart weathered the first gaffe but not the second, and tendered his resignation this week, effective at the end of the current tax season, state budget director Adam Horst said at a Thursday news conference in which the most recent oversight was disclosed. Two of Eckart's deputies also left the department.

The state is now searching for an outside auditor to review how the state misplaced $525 million, Horst said. He said he also is looking at new budget controls that would help the state identify problems before they fester for years at a time.

"We feel like it's all you can do at this point, and you hope that over time that confidence is warranted," Horst said when asked how he would win back the public's trust.

Republican leaders in Indiana's General Assembly requested a say in picking the auditor. Democrats, who called for an independent audit of the state's budgeting operation after the first mistake was discovered, responded "we told you so" to Thursday's news.

Daniels may have the most on the line as he winds toward the end of his eight-year run as governor and continues touring the nation as one of the Republicans lead budget experts.

Since Daniels announced last year he would not run for president, he still is mentioned in Republican circles as a possible pick for vice president, although he has adamantly stated the same family concerns that kept him out of the presidential race would keep him from joining a ticket. Daniels left on a private trip to Israel on Tuesday, the same day he found out about the tax problem. He would not be available to take any questions, spokeswoman Jane Jankowski said Thursday.

"We discovered a problem, took responsibility, acted immediately and fixed the problem," Jankowski said Thursday. "The state is projecting a $1.85 billion surplus, largely because of additional cost savings by agencies and stronger than expected revenues. Indiana's fiscal position is stronger than ever."

The governor's critics say he has skated on the national stage, while bungling management of the state. Beyond the two tax errors, they point to the state's legal battles with IBM over the privatization of welfare delivery and problems at the Department of Child Services.

"That's one bad legacy," House Democratic Minority Leader Patrick Bauer said Thursday. "I don't know how he's able to overcome that."

Darrell West, vice president and director of Governance Studies at The Brookings Institution, said the latest gaffe could hurt Daniels' image.

"Mitch Daniels has a reputation for running a tight ship so continuing problems in the administration of state government harm that image. It is hard to understand how millions of dollars weren't distributed properly," West said. "The governor has to deal effectively with these issues and make sure they don't keep happening. Otherwise, people will reassess how they judge his stewardship."

Horst did not give an exact date for when Eckart would leave his post. The two other top revenue officials, Chief Information Officer Roy D. Gabriel and Chief Financial Officer Darrel Anderson, left after the error was discovered, Department of Revenue spokesman Bob Dittmer said. Eckart was not available for questions Thursday, Dittmer said.

The revenue department says the mishandled money will be distributed with interest to the 91 of Indiana's 92 counties that have local income taxes.

Scientists analysing prehistoric global warming say thawing permafrost released massive amounts of carbon stored in frozen soil of Polar Regions exacerbating climate change through increasing global temperatures and ocean acidification.

Although the amounts of carbon involved in the ancient soil-thaw scenarios was likely much greater than today, the implications of this ground-breaking study are that the long-term future of carbon deposits locked into frozen permafrost of Polar Regions are vulnerable to climate warming caused as humans emit the greenhouse gas carbon dioxide by burning fossil fuels for energy generation.

Researchers in centres across America, Italy and the University of Sheffield, analysed a series of sudden, and extreme, global warming events - called hyperthermals - that occurred about 55 million years ago, linked to rising greenhouse gas concentrations and changes in Earth's orbit, which led to a massive release of carbon into the atmosphere, ocean acidification, and a five degrees Celsius rise in global temperature within just a few thousand years.

It was previously thought that the source of carbon was in the ocean, in the form of frozen methane gas in ocean-floor sediments but now the experts believe the carbon released into the atmosphere millions of years ago came from the Polar Regions.

Professor David Beerling, of the University of Sheffield's Department of Animal and Plant Sciences, said: "For the first time, we have linked these past global warming events with a climatically sensitive terrestrial carbon reservoir rather than a marine one. It shows that global warming can be amplified by carbon release from thawing permafrost."

"The research suggests that carbon stored in permafrost stocks today in the Arctic region is vulnerable to warming. Warming causes permafrost thaw and decomposition of organic matter releasing more greenhouse gases back into the atmosphere.

"This feedback loop could accelerate future warming. It means we must arrest carbon dioxide emissions released by the combustion of fossil fuels if humanity wishes to avoid triggering these sorts of feedbacks in our modern world."

The breakthrough was made through cross-disciplinary collaborations with climate and vegetation modellers, isotope geochemists and permafrost experts led by Rob DeConto at the University of Massachusetts, in collaboration with the University of Sheffield, Yale, the University of Colorado, Penn State, and the University of Urbino, Italy.

Rob DeConto added: "Similar dynamics are at play today. Global warming is degrading permafrost in the north Polar Regions, unlocking once-frozen carbon and methane and releasing it into the atmosphere. This will only exacerbate future warming in a positive feedback loop."

The temperature of Earth's atmosphere is a result of energy input from the sun minus what escapes back into space. Carbon dioxide in the atmosphere absorbs and traps heat that would otherwise return to space.

The global warming events were accompanied by a massive input of carbon to the atmosphere plus ocean acidification, and were characterized by a global temperature rise of about five degrees Celsius within a few thousand years.

Until now, scientists have been unable to account for the massive amounts of carbon required to cause such dramatic global warming events and Antarctica, which on today's Earth is covered by kilometres of ice, has not been appreciated as an important player in such global carbon dynamics.

The research is published in the journal Nature.

New light shed on catalytic reactions used by plants to split oxygen from water

ScienceDaily (Apr. 2, 2012) ? Splitting hydrogen and oxygen from water using conventional electrolysis techniques requires considerable amounts of electrical energy. But green plants produce oxygen from water efficiently using a catalytic technique powered by sunlight -- a process that is part of photosynthesis and so effective that it is Earth's major source of oxygen.

If mimicked by artificial systems, this photocatalytic process could provide abundant new supplies of oxygen and, possibly hydrogen, as a by-product of producing electricity. However, despite its importance to the survival of the planet, scientists don't fully understand the complex process plants use to harness the sun's energy.

A paper published April 2 in the journal Proceedings of the National Academy of Sciences moves scientists closer to that understanding by showing the importance of a hydrogen bonding water network in that portion of the photosynthetic machinery known as photosystem II. Using Fourier transform infrared spectroscopy (FT-IR) on photosystem II extracted from ordinary spinach, researchers at the Georgia Institute of Technology tested the idea that a network of hydrogen-bonded water molecules plays a catalytic role in the process that produces oxygen.

"By substituting ammonia, an analog of the water molecule that has a similar structure, we were able to show that the network of hydrogen-bonded water molecules is important to the catalytic process," said Bridgette Barry, a professor in Georgia Tech's School of Chemistry and Biochemistry and the Petit Institute for Bioengineering and Biosciences. "Substituting ammonia for water inhibited the activity of the photosystem and disrupted the network. The network could be reestablished by addition of a simple sugar, trehalose."

In the chloroplasts of green plants, algae and cyanobacteria, oxygen is produced by the accumulation of photo-induced oxidizing equivalents in a structure known as the oxygen-evolving complex (OEC). The OEC contains manganese and calcium ions. Illumination causes oxidation of manganese ions in the OEC. Short laser flashes can be used to step through the reaction cycle, which involves four sequential light-induced oxidation reactions. Oxygen is produced on the fourth step, and then is released from the OEC.

This so-called S state cycle resets with the binding of the substrate, water. Scientists have proposed that a hydrogen bond network, which includes multiple water molecules bound to manganese ions, calcium ions, and protein amide carbonyl (C=O) groups, forms an electrostatic network surrounding the OEC. In this scenario, the extensive hydrogen-bond network would then serve as a component of the catalyst, which splits off oxygen.

To study the process, Barry and graduate student Brandon Polander used precision FT-IR spectroscopy to describe how the network reacts to a short laser flash. The second harmonic of a pulsed Nd-Yag laser was used as the light source. This illumination causes the OEC to undergo one step in its catalytic cycle, the so-called S1 to S2 transition. An infrared spectrum was recorded before and after a laser flash to the photosystem sample, which was isolated from supermarket spinach.

The exquisite sensitivity of FT-IR spectroscopy allowed them to measure changes in the bond strength of the protein C=O groups. The energies of these C=O groups were used as markers of hydrogen bond strength. The brief laser flash oxidized a manganese ion and caused a change in the strength of the C=O bond, which reported an increase in hydrogen bonding to water molecules. When ammonia was added as an inhibitor, a decrease in C=O hydrogen bonding was observed instead. Addition of trehalose, which is known to change the ordering of water molecules at the surface of proteins, blocked this effect of ammonia.

The study describes the coordinated changes that must occur in the protein to facilitate the reaction and shows that the strength of the hydrogen-bonded network is important.

"This research helps to clarify how ammonia inhibits the photosystem, which is something that researchers have been wondering about for many years," Barry explained. "Our work suggests that ammonia can inhibit the reaction by disrupting this network of hydrogen bonds."

The research also suggests that in design of artificial devices that carry out this reaction, sustaining a similar hydrogen-bonding network may be important. The stabilizing effect of trehalose discovered by Polander and Barry may also be important.

Beyond the importance of understanding the photosynthetic process, the work could lead to new techniques for producing hydrogen and oxygen using sunlight. One possibility would be to add a biomimetic photocatalytic process to a photovoltaic system producing electricity from the sun.

"In terms of providing new sources of energy, we still have lessons to learn from plants about how they carry out these critical processes," Barry said. "It would be a great advance for the planet to have new, sustainable, and inexpensive processes to carry out this reaction."

Ultimately, she hopes the full water oxidizing cycle can be explored and potentially harnessed or imitated for oxygen and energy production.

"We are only looking at a single part of the overall reaction now, but we would like to study the entire cycle, in which oxygen is produced, to see how the interactions in the water network change and how the interactions with the protein change," Barry said. "The work is another step in understanding how plants carry out this amazing series of photosynthetic reactions."

(AP) ? Visa Inc. has dropped the card processor involved in a massive data breach from its registry of providers that meet data security standards.

Global Payments CEO Paul Garcia noted that the company continues to process Visa transactions, but that being dropped from the registry "could give our partners some pause that they're doing business with someone who experienced a breach."

Garcia said he expects to Global Payments to be reinstated once it has been issued a new report of compliance. But he declined to specify when that might be. He said the situation is "absolutely contained" but that the investigation is continuing and that parts of it still need to be resolved.

Global Payments says the data breach may affect less than 1.5 million credit cards from various issuers in North America. The company said that credit card data may have been stolen, but that cardholder names, addresses and Social Security numbers were not obtained.

The company said it will set up a website later Monday to help consumers who might be affected by the breach.

Both Visa and MasterCard say their own systems weren't compromised.

Visa and MasterCard had said Friday that they notified their card holders of the potential for identity theft and illicit charges because of the breach.

Aside from the U.S., Global Payments provides its services to government agencies, businesses and others in Canada, Europe and the Asia-Pacific region.

The company said it continues to work with regulators, industry third parties and law enforcement to help in the effort to minimize the potential impact on credit cardholders.

Last June, hackers stole information for 360,000 credit card accounts at Citigroup. In the past year, there have been high-profile data attacks against the International Monetary Fund, National Public Radio, Google and Sony's PlayStation Network.

For the three months ended Feb. 29, the company reported net income of $57.9 million, or 73 cents per share. That's compared with $48.2 million, or 59 cents per share, in the year-ago period.

The company has not yet identified the size of the charge it will take as a result of the breach.

With the tea leaves continuing to point toward former Giants, Patriots, Jets, and Cowboys coach Bill Parcells coming out of retirement for a one-shot opportunity to win a walk-off Super Bowl and cement his Hall of Fame legacy, not much has been said about the in-house candidates for the interim head coaching job.

A league source tells PFT that the current Saints assistants who had been mentioned as potential replacements for coach Sean Payton (offensive coordinator Pete Carmichael Jr., offensive line coach Aaron Kromer, and defensive coordinator Steve Spagnuolo) aren?t happy with the possibility of an outsider like Parcells swooping in and taking the job.? Carmichael, 40, joined the Saints with Payton in 2006, and Carmichael ran the offense while Payton was relegated to the booth as he recovered from a broken leg.? Kromer, 44, arrived in 2008 and also is in charge of the running game.? Spagnuolo, 52, has three years experience as a head coach, and his Rams delivered one of the three regular-season losses endured last year by the Saints.

As the source explained it, the thinking is that Parcells would simply run the press conferences and decide whether to go for it on fourth down, with Carmichael in charge of the offense and Spagnuolo in charge of the defense.? If that?s all Parcells would be doing, why do the Saints need him?

The prevailing theory in league circles continues to be that Payton wants an outsider like Parcells because Parcells wouldn?t want to stay beyond 2012, and Payton already has publicly declared that he?ll be back in 2013.? If an in-house interim head coach enjoys a high level of success in 2012, owner Tom Benson may decide to make a change.? If the Saints win the Super Bowl at the Superdome, Benson may have no other choice but to promote the interim coach into Payton?s job.

The other side of this particular coin, however, is that an outsider may be necessary in order to prevent any friction between the assistant who gets bumped up and the other two who don?t.? Indeed, a cynic may say that the three names were leaked in order to set the stage for an outsider like Parcells to be the only viable solution.

Regardless, the process by all appearances will be moving toward a conclusion soon.? Unless the Saints plan to have no head coach when offseason workouts begin on April 16, Parcells or someone else will be getting the job within the next two weeks.

Whole Foods Market announced it would stop selling wild-caught fish species threatened by overfishing.

One fish, two fish ??but there's no?"red fish" anymore, at least not at Whole Foods. Organic and natural-foods chain Whole Foods Market announced it would stop selling wild-caught fish species labeled "red," or threatened by overfishing, by the Blue Ocean Institute and Monterey Bay Aquarium.?

The company said in a statement Friday it will stop selling these fish on April 22, Earth Day, and that it will be the only national grocery retailer that doesn't sell "red" fish. Species it will no longer stock include?Atlantic halibut, grey sole and skate, along with others, the company said.

The aquarium and the environmental group use color coding ??green, yellow and red ??to help consumers identify fish deemed to be in ecological danger or caught in an unsustainable manner. A red rating means "avoid" consuming these fish entirely.

Previously, Whole Foods labeled the fish it sold by color it sold so consumers with environmental concerns would know what to avoid. The retailer already didn't sell other species considered at risk like orange roughy and bluefin tuna.?

But at least one prominent seafood brand called the Monterey Bay Aquarium's ratings into question. According to trade publication Nation's Restaurant News, Legal Sea Foods broke with the conservation group last year, choosing instead to rely on sustainability data provided by the National Oceanic and Atmospheric Administration and National Marine Fisheries.?

Legal Sea Foods president and CEO Roger Berkowitz told?Nation's Restaurant News that?his company?wanted to debunk "myths that these fish are not sustainable.? He was referring to species like hook-caught cod from the Gulf of Maine, which currently has a yellow rating on Monterey's Seafood Watch list, and imported black tiger shrimp, which is rated red by the group.?
