Small Tobacco Retailers Worry Prop. 29 Would ?Shut Them Out ...

SAN FRANCISCO?Carlos Solorzano, chief executive officer of the San Francisco-based Latin American and Caribbean Business Chamber of Commerce (LACBCC) says he firmly supports cancer research. He supports prioritizing smoking prevention education, especially for communities of color.

But neither he nor the LACBCC supports Proposition 29, a statewide tax increase proposal on cigarettes and tobacco products to be voted on in California?s presidential primary elections on Tuesday. The California Asian Pacific Chamber of Commerce and the California Black Chamber of Commerce are also against Proposition 29.

In an email received on Monday from the California Asian Pacific Chamber of Commerce (CAPCC) Gordon Hinkle, Director of Public Policy and Communications noted why the CAPCC opposes the measure. "Despite raising nearly a billion dollars a year to fund the new program, the measure includes no requirements that any funds be dedicated to small or disadvantaged businesses or minority businesses," he wrote.

Interviews with Solorzano and other small business retailers who sell tobacco products in San Francisco revealed that most, but not all, oppose the measure.

The key reason for Solorzano?s opposition, he said, is that the California ballot initiative shuts small businesses out.

If it passes, he said, ?You?re taxing big corporations, but not considering helping small businesses. They are hurting.?

?If the taxes were for California, we would understand, but that?s unclear. We need to invest in California small businesses -- the state needs the money,? he said.

Solorzano?s concern is that the proposition?s language is misleading, lacks transparency and provides no guarantee that the $735 million annually in new taxes will ?be spent in California to help the economy or fund education.?

Steep Prices to Pay

According to the Legislative Analyst?s Office of California, if Prop. 29 is passed, effective October 2012, the cost of cigarettes will increase by $1.87 per pack. Proposition 99 and Proposition 10, passed in 1988 and 1998 respectively, have generated the vast majority of tobacco-tax revenues.

If Prop. 29 passes, though, there will still be 22 states where cigarette-pack prices are higher than California?s. The average price of cigarettes in this state will increase to over $6. New York is ranked highest in the nation for cigarettes, where a pack costs nearly double that amount.

According to MapLight, a nonpartisan, nonprofit organization that tracks campaign finance, those opposing Prop. 29 have raised $46.7 million, with funding led by Philip Morris ($27.5 million contributed) and R.J. Reynolds ($11.2 million) tobacco companies.

The Yes on 29 Campaign, in contrast, has raised a total of $12.2 million, with The American Cancer Society and the Lance Armstrong Foundation giving $1.5 million. The bicycle champion has also appeared in the campaign?s advertisements.

According to the Public Policy Institute of California poll released May 23, just over half of likely voters say they would support Proposition 29, a big decline from March.

However, survey results from the Field Poll released last Thursday show that 50 percent of likely voters would support the measure, versus 42 percent opposed and 8 percent undecided.

?Things Will Stay the Same?

John, a tobacco shop owner in San Francisco?s Civic Center Plaza, who declined to state his surname, but said he is an Afghan American, thinks passing Proposition 29, would be a ?mistake.?

?I don?t support this cigarette tax or any cigarette tax,? he said.

Stressing that he is following the issue closely?and believes the proposition will pass?John asserted, ?I think there is enough tax as it is. The truth is, if they want to make America safe, increase alcohol tax. Someone is involved in an automobile accident every 10 seconds, and a lot of that is because of drunk driving.?

?It wouldn?t solve anything,? he said. ?What it?s [Proposition 29] trying to fix will stay the same.?

Tino Vercetti, a convenience store employee of European and Iraqi descent on Fillmore Street was also concerned that the government was not focusing on other health issues, such as obesity.

?You just keep raising taxes on cigarettes--nobody does anything about the fatty foods,? he contended.

Other small business owners, such as Moe Khatib, who owns the Smoke Shop on Haight Street, are more supportive of the proposition, although they acknowledge it won?t be good for business.

?This will hurt small businesses in general,? he said. ?I can?t really predict where the money will go, but I assume there will be monitoring.?

?If money is going to treatment and research, it?s worth it,? Khatib said.

?Separate Issues?

Data on California tobacco use from the U.S. Center for Disease Control and Prevention show there are 3.6 million adult smokers and 200,000 youth who say they light up.

The statistics suggest smoking is greater in minority communities. For instance, the highest level of smokers in the Golden State is 18.9 percent among African American men.

The next highest rates are Hispanic men, 15.5 percent, and black women, 15.2 percent. Smoking among whites is slightly lower, at 14.3 percent for both men and women, with Asian males at 13.1 percent.

There are approximately 36,700 licensed tobacco retail stores in California. Research published in 2009 in the American Journal of Public Health, revealed that California has a higher density of tobacco retailers within one mile of urban schools and in predominately low-income, ethnic minority communities.

But ?you need to separate these issues,? contended Allen Gutierrez, chief executive officer of The Latino Coalition, among the groups opposing Prop. 29.

?We are all for research. That is first and foremost,? he said. ?However this proposition, it?s flawed,? Gutierrez insisted, asserting that the measure lacks ?accountability and efficiency.?

Julian Canete, president and CEO of the California Hispanic Chamber of Commerce, commented, ?We don?t oppose cancer research; there?s not a single family or individual who hasn?t been affected by this disease--we want to find a cure. The federal government spends $6 billion on cancer research--it?s not enough, but this is not the answer,? he said.?

Canete suggested that politicians raising campaign funding could also support fundraising for cancer research. Noting that Barack Obama and Hillary Clinton each raised close to $400 million for their 2008 primary campaigns, he said, ?That?s almost a billion. Why can?t you do the same in cancer research??

For small business owners and advocates alike, another essential component missing from Proposition 29 is smoking-cessation education with funds specifically allocated to California.

?In the past,? Solorzano?of LACBCC said, ?tobacco companies were obligated to give money to promote smoking cessation. Schools didn?t want the money because it was tobacco money, but we should use it for education. The research can only go so far,? he said.

?If there were a better-written proposition I think the opposition would be different, but right now there are too many red flags,? said Gutierrez of The Latino Coalition.

After I say Preparation Training I mean just that, realistic and relevant training that PREPARES you for a workplace violence incident as a result of you can?t forestall all incidents of workplace violence.

I cannot emphasize this enough! If you can?t get this happening at your workplace then take a personal safety course. Most folks agree that they would really like to be and feel safer but most individuals will not take the mandatory steps to make this happen.

The simplest way for you to successfully resolve a potentially violent state of affairs is to organize yourself by taking appropriate coaching from a coach who has been in these situations and is aware of what works. Anything less and you?re simply fooling yourself!

If you?re a manager and one in every of your employees has approached you with a concern, take it seriously, investigate it, document what you?ve got found and deal with it. Losing Large Amounts Of Weight And Keeping It Off Is A Lifestyle ...

Being overweight and even obese is not only very unhealthy, it also becomes extremely frustrating and hard to deal with, as all of your weight loss efforts are either short-lived or just don?t work.? And then losing large amounts of weight seems so overwhelming.

For instance, maybe you are overweight 40-50 pounds, or even as much as 60, 80, or 100 pounds and an amount that by definition would make you obese ? and it has gotten to the point that the thought of ever getting back to your ?ideal? weight doesn?t seem possible?

Or maybe you have tried diet after diet that simply didn?t work, and now you have completely given up on trying to lose weight ? and have convinced yourself that you are destined to be fat, and there is nothing that you can do about it?

This is the situation with a tremendous number of people.? However, it is very possible to lose large amounts of weight and ?beat? obesity, but this clearly isn?t going to happen with another ?fad? diet.

Nutrition And Fitness Lifestyle Changes

Effective long-term weight loss and control comes when it becomes a way of life.? Or what I think of as a nutritional health lifestyle that includes dietary changes that are more centered on nutrition instead of counting calories, along with the addition of exercise and fitness.

Let me tell you my own story about losing 55 pounds, becoming extremely fit in spite of lower back problems ? and keeping the weight off for over 3.5 years now.

I Remember It All So Well

I grew up as a competitive and scholarship athlete, and if anything, I was trying to gain weight when I was in high school.? But my eating habits were horrendous ? not only did they include very large amounts of sugar and bad fats; I could eat tremendous amounts of food.

I remember the days of eating a 16? pizza myself.? And does anyone reading this remember Howard Johnson, and their 9 scoop sundaes, with whip cream, nuts, and hot fudge?? I never tried to eat two of them, but eating one wasn?t a challenge.

I didn?t know anything about nutrition and didn?t care; I thought I was very healthy and certainly didn?t have any weight problems ? now fast forward:

  • A few years after college I started a business.? And although I was still very active playing racquetball, it was certainly not the same number of hours and intensity of overall exercise that I had through school.
  • My eating was still the same nutritionally, and I kept eating whatever and as much as I wanted ? I gained around 10 pounds, but no big deal, I was getting older.
  • My business grew and I started a second one, and I also badly hurt my lower back and couldn?t play racquetball anymore.
  • But now I gained 25 pounds and still didn?t do anything about it ? it wasn?t my fault that I had an injury, and my businesses were doing really well, and that was my priority.
  • In 1992 my dad died from complications of open heart surgery, and then the following year my mom also needed open heart surgery, but she got through it fine.
  • By then I had gained 30 pounds and weighed 200 pounds, and was doing no exercise at all ? I did go to the doctor and found out that my cholesterol was 235, and started taking Zocor to get it back down to around 200.
And Then October 2008 Came

By 2008, I had gained 55 pounds and weighed 225.

I had sold my two businesses and was now making my living as a day trader and money manager.? I had become busier and more stressed than ever.? And my idea of exercise was walking to the mailbox to get the mail [I obviously didn?t have time to do anything else, and it would hurt my back anyway] ? I ?huffed and puffed? when I walked up the stairs in our house.

And then October came.

It was around 9:00 am and I was working ? and all of a sudden my heart started racing like I had run a marathon.? I told my wife what was going on [my office was in our house] and went to lie down.? That seemed to help, but when I tried to get up again my heart started beating faster than before ? and then the pain came.

911 was called, and an ambulance took me to the emergency room.? I apparently hadn?t had a heart attack, but my heart rate was in the high 190s, and the medicine I was given wouldn?t bring it back down.? I was eventually ?put under? so they could ?hit me? with the paddles, and finally my heart was converted back to a normal rate.

When I was stabilized and could talk to the cardiologist, he read me the riot act, which was nothing compared to what my wife had to say:

  • The doctor told me that I had Atrial Fibrillation
  • He said ?that was the fastest heartbeat he had seen by someone who remained conscious
  • That I was a time bomb for more of these episodes that I may not survive, if I didn?t have a stroke first
  • And that I was obese

I was in the hospital for 4 days and had a stress test that had to be done chemically, because I couldn?t do it on the treadmill.? I also had a heart catheterization, where I found out that I had two arteries that were over 30% blocked ? borderline, but not quite bad enough to have stents put in.

I finally got to go home, amidst a huge number of threats from my wife and 2 daughters ? about what was going to be done to me, if I didn?t start dieting and lose weight.

I didn?t know exactly what and how I was going to do what needed to be done, but I did know just how far off base my wife and daughter were ? I didn?t need to go on another diet.

My Nutritional Health And Fitness Lifestyle Journey

And it was a journey, but one that never included going on a diet.

I had gone on plenty of different diets in the past, and I would lose 10-15 pounds and then gain it all back, if not more.? I had a good friend who wanted me to go on the Atkins Diet with him ? he actually lost around 25 pounds, but then put 35 back on.

But what I never had done was really learn about foods and get a good nutrition education.

As I did that, I quickly learned that nutritional health, along with weight and fat loss, ?was far more about what foods were being eaten, than it was about simply trying to eat fewer categories.

And I certainly had never quit making the ?no time and back pain? excuses for not exercising; if nothing else, I was very capable of starting a good walking program.

I was lazy [dumb] and just didn?t want to do it.? So I kept making the excuses for why I couldn?t ? and like so many other people have done, I actually convinced myself that they were all true ? what a crock of ?you know what?.

Now It?s June 2012

So, it?s now June 2012, and over 3.5 years since ?my day? in October 2008 ? here is how and what I am doing:

  • I have a very good [and continuing] education and understanding about nutritional health and fitness.? It has become a passion of mine, and if I had it to do over again, I would have gotten a related degree when I was in college.
  • I currently weigh 170 pounds, which is 55 pounds less than my peak.? It took me around 4 months to lose my first 35 pounds ? and it has remained consistent between 168 and 175 for over 3 years.
  • My cholesterol has gone done from 235 to 145 ? I have kept taking a statin because of my ?heart genes?.
  • I have been off of blood pressure medicine for over 2.5 years.
  • I hate to even write this [karma] ? but knock on wood, I have not had any more heart ?episodes?.
  • I try to work out for at least an hour every day, and do both cardio and weight lifting.? Yeah, I still have back problems, but they have gotten way better as I lost weight and became more fit ? go figure.
  • My week day workouts are usually 60-90 minutes, starting at 5:30 am ? I prefer doing this in the morning before work and having no issues at all with how late I work, or feeling too tired later in the day.? And my weekend workouts are usually 90-120 minutes.
  • This morning I did a chest and ?core? workout for 70 minutes ? it included some bench press reps at 170 pounds [and before I am gone, I am going to somehow do at least 1 rep at the ?magic? 200 pounds].? I usually split up my weight lifting to 1-2 body parts and also include ?core? exercises.
  • Yesterday was 95 minutes and 7.5 miles on the treadmill ? I usually only spend 30-40 minutes on cardio.? I did different intervals including (1) a 3-12 degree incline ?Hill Trecker? program at 4-4.5 miles per hour (2) 12-15 degree incline walking at an average of 5 miles per hour (3) 0-3 degree incline jogging for 5-7 minutes at an average of 7.5 miles per hour ? I try to keep any of the interval rest periods to 3-4 minutes, and at 3-5 degree walking at an average of 4 miles an hour.
  • I am going to be 60 years old in 2 months.
I Have Not Done Anything That Most Anyone Else Couldn?t Do Too

I want to finish this with making what I feel are some important points ? sorry for dragging this all out so long? :-P

  • Like many people, I made my changes because I had no choice because of a health issue ? it certainly would have been a far better decision, and far easier to do, if I had done so before I had to.
  • My age ? and that you can ?teach an old dog new tricks?.
  • Nutritional health and fitness is a lifestyle journey that takes education, discipline, and commitment ? it is not about going on a diet, if you want long-term results that continue to last and ever get better.
  • I very pleased with what I have been able to do, and also know it has become so ingrained in how I live that I know I won?t revert back to how I was previously.
  • But I don?t think that I am special, or that I have accomplished anything ? that most anyone else, who had the willingness and determination to change, couldn?t do too.

I will write more about specific steps that I took when I got started ? 55 pounds overweight, and so badly out of shape that the gym I joined made me bring in a letter from my doctor saying that it was ok to work out.? But I wanted to get started by stressing that the objectives and results come from lifestyle changes that everyone can make to some extent.

It's hard to imagine a time when there wasn't a Morgan Freeman on our screens. The Oscar-winning actor, who turns 75 today, has been performing since he was 9 years old and in the ensuing years he's used his sonorous, commanding voice and soulful, charismatic presence to play dozens of roles -- God, the president, a convicted criminal, a chauffeur and an easy-reading hipster, just to name a few.

Freeman has a versatility that can make him menacing, warm, superhero-like and an everyman -- he's never gotten typecast. Sure, he's played his share of sidekicks (sometimes while appearing with Thursday's birthday boy and friend Clint Eastwood in movies like "Unforgiven" and "Million Dollar Baby") but Freeman is the rare actor who can ease straight into the driver's seat of a film (literally in "Driving Miss Daisy"), and no one blinks.

Though he's made some headlines recently -- no, he's not going to marry his step-granddaughter -- there's no question that the Memphis-born Freeman remains one of Hollywood's most beloved actors. In the end, there's no question that you fell in love with his talent and abilities -- the question is only when it happened.?

Tipp City?s June 23 Antique & Artisan Show is a great way to welcome summertime. Organizers say the arts, crafts, and antiques featured at the show provide unique gift ideas or decorative statements.

?It is a chance to meet talented artisans, enjoy home town entertainment, and purchase a variety of beautiful antiques. And, it?s a great opportunity to plan a day trip to a warm and welcoming community with amazing restaurants and fascinating shops,? said show coordinator Terri Bessler, adding that, ?if you are a history buff, then you will love the rich heritage of this former canal and railroad town.?

This is the ninth year year for the show, which features a premier display of antiques from Ohio and surrounding states as well as a diverse array of artisans from all over the Midwest. More than 80 venders will participate, attracting thousands of delighted visitors who will enjoy displays, shopping, demonstrations, local food, entertainment and the town?s famed farmers market.

?Our downtown welcomes you to our local shops and restaurants,? said Bessler, a board member on the Downtown Tipp City Partnership (DTCP). ?Hickory River Smokehouse and Sam & Ethel?s Restaurants will be cooking wonderful food on the street during the event. Local entertainment will be featured at 3rd & Main Streets. Visitors will enjoy the Tip Top Tappers who will clog to popular music, Mezzelis?s Midnight Mirage Belly Dancers, Midnight Rider, and The Broken Lights, both local bands, and McGovern Ceili Irish Dancers, as well as various other local talent. It is a thoroughly enjoyable event for the whole family.?

The annual event not only showcases local and regional talent and artistry but also helps to support the Downtown Tipp City Partnership and many unique programs designed to Preserve, Energize, and Promote the inviting hometown atmosphere of downtown Tipp City.

?We are blessed to have a community that really pitches in and helps one another. Our events and activities depend on an amazing cadre of volunteers who always rise to the challenge,? said DTCP Executive Director Tara Dixon Engel. ?It is funny how so many shopping malls today are trying to capture the look and feel of small town America. That?s nice, but why go to a synthetic small town to shop when you have a REAL one right here just waiting for your visit! The Antique and Artisan Show is a great way to get to know Tipp City. Gloria Allred Now Representing Girlfriend Of Rudy Eugene, Face-Eating 'Miami Cannibal' (PHOTOS, VIDEO)

High-profile California attorney Gloria Allred has joined the hubbub surrounding Miami's naked "cannibal" attack of last Saturday.

As first reported by CBS Miami, Allred is now representing the long-time girlfriend of 31-year-old Rudy Eugene, who was shot and killed by a Miami police officer while chewing off most of a homeless man's face in broad daylight on the busy MacArthur Causeway.

The girlfriend, who has not been named by media outlets at her request, has said she believes Eugene was either drugged unwittingly or under a Vodou curse.

?I don?t know how else to explain this,? the girlfriend told the Miami Herald, insisting that though Eugene did smoke marijuana he never touched other recreational drugs. She said she saw news of the attack on TV Saturday night, but didn't know her missing boyfriend was both dead and the responsible for the grisly crime until Sunday.

"I'll never be the same," she told the Herald.

It is not yet apparent why the girlfriend, with whom Eugene spent his last night, has legal representation. Allred declined to comment beyond confirming her position to NBC Miami in an email, and according to the CBS report "Allred...has no plans at the moment to release a statement, hold a press conference or visit the girlfriend in Miami."

Allred, who is known for taking cases involving women's rights, has previously represented high-profile clients including Spice Girl Mel B., Tiger Woods ex Rachel Uchitel, the family of Nicole Brown Simpson, actress Hunter Tylo, one of John Travolta's accusers, and the ex-girlfriends of Charlie Sheen and Shaquille O'Neal.
